Trademark Renewal

Trademarks need to be renewed every 10 years. A trademark renewal guarantees continued legal rights of the trademark holder. In case, the holder of a trademark fails to renew the trademark; they lose all the protection on the trademark.

A trademark renewal application needs to be filed within 6 months of the expiration of the registered trademark. In case, the person owning the trademark fails to file a renewal application within 1-3 months of the mark getting expired; the trademark registrar sends a reminder.

If the owner fails to apply for trademark renewal even then; a renewal application can be filed by filing form Tm-10 within 6 months of the registered trademark having expired by paying a surcharge. Failing which, the trademark will be removed from the registry.
